Contract Terms and Conditions

By booking Sister Scout Studio for your photography project, you agree to abide by the following terms:

Payment and Fees

The Client agrees to pay the fees and expenses to Sister Scout Studio.
If any amount payable under this Agreement is the consideration of a taxable supply under GST Law, then GST, calculated in accordance with GST legislation, must be paid in addition to the amount specified in this Agreement at the same time and in the same manner as the Fees and Expenses. All stamp duties and governmental charges, if any, arising out of or incidental to this Agreement are the responsibility of and must be paid by the Client.

Booking Deposit

Full payment, including GST is required to secure your Mini session.

Subject to the cancellation terms below, your booking deposit is transferable to another date/time should you need to reschedule your headshot session, subject to availability. Once the Client has made a booking for a specific time and date, Sister Scout Studio will not accept any other work from other clients for those times and dates for the assigned Photographer.

Cancellations

Cancellations made more than 48 hours prior to your headshot session time will receive 50% of your deposit as a refund. Cancellations within 48 hours of a booking will forfeit the full amount, unless due to an emergency or health reasons.

Provision of RAW Files

Sister Scout Studio will edit and deliver what it considers to be the best of every situation covered. As a result, RAW files will only be supplied to the client in exceptional circumstances (which may include additional fees) and only when those RAW files have not been deleted. Sister Scout Studio makes no undertaking to keep any files not intended for use.

File Delivery

Subject to the payment terms below, print resolution files (4500px on long edge, 300dpi, in JPG format) of the agreed number of images will be available online within 20 business days, in your client gallery, unless an arrangement is made otherwise.

Final Payment

Sister Scout Studio reserves the right to withhold files at their discretion where an invoice remains unpaid.

Copyright

Sister Scout Studio asserts all moral rights and ownership attached to the images. The entire copyright in the images is retained by the photographer representing Sister Scout Studio at all times throughout the world.

Third Party Use

Images may not be sold to a third party without the prior written consent of Sister Scout Studio.

Image Credits

Crediting of photography is not required for the Client’s own use of images, for example on the client’s business website or social media (although it is always appreciated). Images supplied to a third party, for example a magazine, newspaper or industry website, must be credited to Sister Scout Studio.

Use of Filters and Further Editing

Where additional editing has been applied to images supplied by Sister Scout Studio, for example the use of filters in social media, no credit shall be given to the photographer as the image is no longer a true representation of Sister Scout Studio’s work

Liability and Indemnity

While Sister Scout Studio takes all reasonable care in the performance of this agreement generally, it shall not be liable for any loss or damage suffered by the Client or by any third party arising from use or reproduction of any image.

In the unlikely event that the photographer(s) are injured, ill, or has an emergency that prevents them from photographing the event, Sister Scout Studio will contact the Client as soon as possible, to arrange another suitable date and time.

Sister Scout Studio takes the upmost care with respect to exposure, storage, and processing the photographs/images, but cannot and does not, guarantee that photographs/images of the event will not be lost, stolen, or destroyed for reasons within or beyond Sister Scout Studio's control.

The Client agrees that Sister Scout Studio or the photographer(s) full and complete responsibility and liability under this Agreement is limited to the return of all payments received for the event.

The Client agrees to indemnify Sister Scout Studio in respect of any claims or damages or any costs arising in any manner from the reproduction without proper reproduction rights of any image supplied to the Client by Sister Scout Studio or for any other breach by the Client of this Agreement.

It is the Client who must satisfy himself that all necessary rights, model releases or consents which may be required for reproduction, are obtained and it is acknowledged that Sister Scout Studio gives no warranty or undertaking that any such rights, model releases or consents have or will be obtained whether in relation to the use of names, people, trademarks, registered or copyright designs or works of art depicted in any image. In the event that the image issued or reproduced by or with the authority of the Client then the Client shall indemnify Sister Scout Studio against any loss or damage, proceedings or costs where such rights, releases or consents have not been obtained.

This Agreement shall be subject to and constructed according to the law in Victoria, Australia and the parties agree to accept the exclusive direction of Victorian Courts.
